1. General

The terms and conditions below (“Terms”) apply to all aspects of telewealth.com (the “Site”) and any products, services, or communications offered by Geekout Events LLC, doing business as TeleWealth (“TeleWealth,” “we,” “us,” or “our”). Before using the Site, purchasing any product or service, or subscribing to any communications, we ask that you read these Terms carefully.

By accessing or using the Site, creating an account, making a purchase, or opting in to receive communications from us, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

When we refer to “you” or “your,” we mean you, the person or entity accessing or using our Site or services.

2. Changes to These Terms

These Terms may be amended at any time without prior notice. Your continued use of the Site and our services after any changes constitutes acceptance of the updated Terms. We reserve the right, at our sole discretion, to change, modify, or otherwise alter these Terms at any time. Unless otherwise indicated, amendments become effective immediately. We encourage you to review these Terms periodically.

4. Registration & Accounts

Some features of the Site may require you to create an account. When you register, you agree to provide accurate and complete information and to keep that information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

By registering your name and email address on the Site, you agree to receive communications from TeleWealth, including transactional emails, service updates, and marketing messages (subject to your opt-in preferences). You can manage your communication preferences at any time. See Section 5 for more details.

You agree to notify us of any changes to your personal information or circumstances that may affect your use of our services.

5. Email & SMS/Text Message Terms

Email Communications

We use Customer.io to send marketing emails, newsletters, product updates, and transactional messages. By opting in to email communications, you consent to receiving such messages at the email address you provide. Every marketing email includes an unsubscribe link, and you may opt out at any time.

SMS / Text Message Communications

We use Twilio to deliver SMS and text message communications. By providing your mobile phone number and opting in to receive text messages from TeleWealth, you agree to the following:

You consent to receive recurring automated marketing and informational text messages from TeleWealth at the mobile number you provided.
Consent is not a condition of any purchase.
Message frequency may vary.
Message and data rates may apply. Contact your wireless carrier for details regarding your plan.
You can opt out at any time by replying STOP to any text message from us. After opting out, you will receive a one-time confirmation and will no longer receive text messages unless you re-subscribe.

We will not sell, rent, or share your phone number or opt-in data with third parties for their own marketing purposes.
Wireless carriers are not liable for delayed or undelivered messages.

Supported carriers include (but are not limited to) AT&T, T-Mobile, Verizon, Sprint, and most major US carriers.

6. Purchases, Cancellations & Refunds

All purchases made through the Site are subject to the specific terms provided at the point of sale. Please review the details of any product or service before completing your purchase.

Unless otherwise stated at the time of purchase, all sales are final. If you believe you are entitled to a refund or need to request a cancellation, please contact us at marketing@telewealth.com. Refund requests will be considered at TeleWealth’s sole discretion.

TeleWealth reserves the right to cancel any order or transaction if we reasonably believe it involves fraud, misuse of promotional codes, or violation of these Terms. In such cases, no refund will be issued.

7. Discounts & Promotional Codes

Discount and promotional codes are subject to the following conditions:

Codes cannot be combined with other offers, promotions, or previously issued credits unless explicitly stated.
Codes must be applied at the time of purchase and cannot be retroactively applied to a completed transaction.
Codes are non-transferable and may only be used by the intended recipient.
Refunds or credits of equivalent value to any discount or promotion cannot be issued.
If an individual is found using a discount code in a manner inconsistent with its intended use, the associated purchase may be cancelled without refund.

TeleWealth reserves the right to modify or discontinue any promotion at any time without notice.

8. Acceptable Use

You agree not to:

Use the Site in any way that breaches these Terms or any applicable local, national, or international law or regulation.
Copy, reproduce, or resell any part of the Site unless expressly permitted in these Terms.
Do anything that may damage, disrupt, or otherwise interfere with the operation of the Site, or any equipment, network, or software used to operate it.
Use the Site for excessive marketing, spam messaging, or implementing automated scripts or bots.
Attempt to gain unauthorized access to the Site, its servers, or any connected systems or databases.
Introduce viruses, trojans, worms, logic bombs, or other malicious or harmful material to the Site.
Attack the Site via a denial-of-service or distributed denial-of-service attack.

Any breach of this section may result in immediate termination of your access and may constitute a criminal offense. We reserve the right to report any such breach to relevant law enforcement authorities and to disclose your identity to them.

9. Ownership & Copyright

All content on the Site — including text, graphics, images, code, design, logos, and trademarks — is owned by or licensed to Geekout Events LLC (d/b/a TeleWealth) and is protected by applicable intellectual property laws. All rights are reserved.

You may not use, reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent, except for personal, non-commercial use.

Any communications or materials you send to us through the Site will be treated as non-proprietary and non-confidential (other than personal information governed by our Privacy Policy). We are free to use any ideas, suggestions, concepts, or feedback contained in such communications for any purpose without compensation to you.

The content on the Site is provided for general information purposes only. It is not intended to constitute financial, investment, legal, medical, or other professional advice.

While we endeavor to keep the information on our Site accurate and up to date, we make no guarantees, warranties, or representations (express or implied) as to its accuracy, completeness, or suitability for any particular purpose.

The Site does not constitute a solicitation to buy or sell any investment, product, or service unless explicitly stated otherwise.

If you have accessed the Site through a link from another website, TeleWealth does not accept any liability or responsibility for the accuracy of information on those third-party sites.

11. Limitation of Liability

Nothing in these Terms excludes or limits our liability for:

Death or personal injury caused by our negligence.
Fraud or fraudulent misrepresentation.
Any matter in respect of which it would be unlawful to exclude or restrict liability.

Subject to the above, by using the Site you agree that:

TeleWealth shall not be liable for any loss of profits, loss of revenue, loss of contracts, failure to realize anticipated savings, or any indirect or consequential loss, whether arising from negligence, breach of contract, or otherwise.
Our total aggregate liability to you for any loss or damage arising out of or in connection with these Terms, whether in contract, tort (including negligence), or otherwise, shall not exceed $100.

We assume no responsibility for the content of any third-party websites linked from the Site. Such links do not constitute endorsement, and we are not liable for any loss or damage arising from your use of them.

12. Force Majeure

“Force Majeure” means circumstances beyond our reasonable control, including but not limited to: fire, flood, earthquake, extreme weather, failure of utilities, building collapse, widespread disease or public health emergency (including pandemic or epidemic), strike or industrial action, outbreak or declaration of war, act of terrorism, revolution, or government orders or action.

TeleWealth accepts no liability and will not be held responsible for any failure or delay in performing our obligations where such failure or delay results from Force Majeure.

13. Suspension & Termination

If you breach any of these Terms, we may immediately, and without prior notice, do any or all of the following:

Issue a warning to you.
Temporarily or permanently remove any content you have submitted to the Site.
Temporarily or permanently withdraw your right to use the Site.
Suspend or terminate your account.
Initiate legal proceedings against you for reimbursement of all costs resulting from the breach (including reasonable administrative and legal costs).
Take further legal action against you.
Disclose information to law enforcement authorities as we reasonably deem necessary.

14. Severability

Each clause of these Terms operates independently. If any court or relevant authority determines that any provision is unlawful or unenforceable, the remaining provisions will continue in full force and effect.

If we fail to enforce any right or provision under these Terms, that does not constitute a waiver of that right or provision. Any waiver will only be effective if made in writing.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the State of Wyoming.
